Friend of the court brief arguing that: (1) a court considering a motion to dismiss a defamation case against a campaign advertiser must consider the campaign context in which advertising takes place in determining whether the advertisement is “capable of defamatory meaning”; and (2) a court should not compel discovery of anonymous campaign or political donors prior to ruling on a motion to dismiss a defamation case on the pleadings. |
